Roman Polanski lost his appeal on Tuesday to be freed from jail, as a Swiss court turned down several offers of 76, director of bail or be under house arrest to reassure the authorities that he would stay in the country. The Federal Criminal Court said Polanski poses too “high” risk of flight if released and that even his Swiss chalet in the luxury resort of Gstaad was sufficient security to prevent escape. The acclaimed film director is considered a criminal and a fugitive from the authorities in Los Angeles, and the United States seeks his extradition in 1977 for having sex with a 13-year-old girl. He was arrested by the Swiss on September 26 when he arrived in Zurich to receive a lifetime award for a film festival. “The court found that the risk of Roman Polanski might flee if released from custody on the top,” the federal court. “The security offered by the appellant does not meet the requirements, as established by law”. However, the court in the southern Swiss city of Bellinzona left open the possibility of several Polanski to challenge his verdict in what is expected to be a long legal battle over his extradition. Polanski has 10 days to appeal the decision on his fitness for the highest court in Switzerland. You can also continue efforts to persuade the Swiss Ministry of Justice to release it. Further proceedings are expected after Washington submitted its formal request for extradition, which has until Nov. 25 to file. Polanski’s lawyer, said Tuesday’s decision was a disappointment. “It is likely that Mr. Polanski will appeal,” Herve Temime told reporters in Paris. “I repeat that Mr. Polanski firmly and strongly said he will stay in Switzerland during the extradition process, whatever the outcome.” The director of film classics as “Rosemary’s Baby” and “Chinatown” was accused of plying the minor with champagne and a Quaalude tablet sedative during a modeling session in 1977, and raping her. He was initially charged with six felony counts, including rape by use of drugs, child abuse and sodomy. He pleaded guilty to a misdemeanor charge of unlawful sexual intercourse. In return, the judge agreed to drop the pending charges and the prison sentence of 90 days of psychiatric evaluation. However, he was released after 42 days by an assessment that is mentally healthy and unlikely to offend again. The judge replied that he would send Polanski to return to prison for the rest of the 90 days and then ask Polanski, a dual French and Polish, according to deportation “voluntary”. Polanski fled the country on 1 February 1978, the day he was scheduled to be sentenced to extra time. Since then, Polanski has lived in France, which does not extradite its own citizens. In its 17-page ruling, the court said Polanski Swiss offered to deliver their travel documents, use an electronic monitoring device and undergo police checks a day. These measures were considered insufficient to prevent his escape, he could always get a new passport or travel to your French home, no papers. The Swiss court is also concerned that Polanski could leave Switzerland and avoid extradition if he fled by helicopter or private plane. Polanski’s lawyers offered Gstaad chalet as security director, saying it represented more than half of his personal fortune and no doubt will ensure their stay in the country because they have two children who must support through school. The court, however, sided with the Swiss authorities, who said that even if insufficient high bail bid against flight safety and must be in cash. The Swiss Justice Ministry said it would review any new submission alleges Polanski and assess whether it represents a “concrete, feasible” to offer as suggested by the court’s ruling. However, the spokesman Folco Galli reiterated that the detention was lifted only in exceptional cases. “The point of prison is to ensure that Switzerland is to meet its obligations under extradition treaties,” Galli told the AP. “You can always ask again to be released. However, detention is the rule.”
